BOOKING TERMS AND CONDITIONS

This information should be read carefully before booking with The Next Steps Forward. We reserve the right to update these Terms and Conditions at any time, without notice.

DEFINITIONS

TNSF means The Next Steps Forward.

The Client means the person named on the Booking Form/taking part in the session.

Responsible person refers to the individual booking/paying for the session if this differs from the client. This person must also have legal parental consent. 

Booking form means the application/referral form submitted to The Next Steps Forward.

In writing means correspondence by post or email.

1. AGREEMENT

Any agreement based on the outline terms and conditions arises upon the fulfilment of the following:

1.1 Receipt & clearance in TNSF bank account of full payment or deposit in section 2 below and a fully completed booking form, a fully completed health form and acceptance by TNSF in writing.

1.2 That the acknowledgement of “I agree” on consent forms will be accepted as an electronic signature and is to be completed by the client (if over 18) or the responsible person (if under 18). This agreement is governed by English Law.

1.3 TNSF reserves the right to refuse bookings to any party or individual without the need to give reasons solely at TNSF`s discretion and we will return any payment accompanying the booking form.

1.4 If bookings are made on behalf of a school please refer to section 2.3 for specific agreements.

2. PAYMENT

2.1 All activities under TNSF will require cleared funds in the account before sessions. 

2.2 Late or refused payments - After 30 days no payment interest will be charged at a monthly rate of 8%. While legal advice is sort.

2.3 School bookings will be made;

  • for 6 weeks (or the length of that half-term) at a time and will be rolling, to cancel a booking slot 3 weeks' notice prior to the next block is needed.              

  • Payment for the first block is to be made within 2 weeks of the invoice being sent. 

  • Subsequent invoices will be set at the end of every term.

  • Payment needs to be made within 4 weeks of the invoice being sent.

  • Failure to process payment in this timeframe will mean that the sessions will be forfeited and will be offered to someone on the waiting list. A further admin charge of £60 will be added to the closing invoice. 

  • If you inform us of planned absences prior to invoices being sent at the end of term we will adjust these accordingly and factor this into our planning.

3. CANCELLATION

The responsible person must be aware of the following conditions and therefore agree to such:

3.1 Whilst every reasonable effort will be made to run sessions as planned, there may be occasions, such as extreme weather or staff illness, that force the need to postpone any programme. In this unlikely event, the Client will be transferred to another date. If a date can not be arranged refunds will be given.

3.2 TNSF reserves the right to cancel any booking without reason or notice when a full refund would be given. Please note – Cancellation means the sessions are cancelled (with no equivalent sessions running in their place).

3.3 For bookings for TNSF kids camps - cancellation more than 7 days before the commencement of the course, payment will be retained but it can be transferred to another course, of equal value subject to availability.

3.4 For bookings for TNSF Therapy sessions - cancellation within 7 days before the commencement of any programme/course by the Learner, full course fee will be retained and no refund given.

4. VARIATION OF SESSIONS BY TNSF

TNSF, by its very nature, is subject to natural forces and whilst every reasonable effort is made to facilitate the session activity book, TNSF:

4.1 Reserves the right to vary or modify a session at short notice in order to take advantage of naturally prevailing conditions.

5. CLIENT CONDUCT

5.1 TNSF clients are expected to behave in a reasonable manner at all times and to comply with the reasonable instructions and directions given by TNSF staff, visiting course leaders and volunteers.

5.2 Accompanying parents, teachers and those in comparable roles with respect to children must maintain appropriate behaviour protocols for the children as required by the staff of TNSF.

5.3 TNSF reserves the right to remove any Client(s) from the session at the discretion of the facilitator/leader without recourse to repayment for that course and against the client(s) will if necessary. Circumstances that may warrant exclusion from a course include (without limitation):

  • Intoxication

  • Use of recreational drugs

  • Abusive behaviour

  • Inappropriate/threatening or continued unsafe use of equipment

  • Inability to meet the rigours of the course for physical or mental reasons

For removal of any party under such conditions, TNSF will not be liable for any losses as a result and TNSF are also entitled to any reasonable costs arising from the removal of the said client(s) payable upon demand.

6. INSURANCE & LIABILITY

6.1 TNSF has Public Liability, Professional Indemnity and Employers Liability Insurance with Activities Industry Mutual, which covers Learners and staff during the taught elements of attending any ECUKCIC course or programme 

6.2TNSF sessions take place outdoors, which by its nature, is never free from hazards. While all reasonable precautions are taken to minimise the risk, the client and responsible person accept that accidents including serious injury and death can occur without TNSF being at fault and to the extent that the client is taking part in a TNSF session entirely at his or her own risk.

6.3 The client and responsible person also recognise that TNSF is not responsible for loss or damage to the personal property of the client, including vehicles, money, clothing and or equipment whilst attending any sessions.

6.4 TNSF accepts no responsibility for any injury during a session from any instruction or information not given by TNSF-appointed staff or assistants.

6.5 TNSF also takes no responsibility for any injury occurring as a result of the client`s failure to follow instructions.

6.6 TNSF only accepts liability for physical injury to the Learner that is shown to result from the negligence of TNSF.

6.7 RE Covid-19 - the client and/or the responsible person confirm they will inform us if they are experiencing Covid-19 symptoms and will not attend any days with TNSF, until safe to do so.

7. COMPLAINTS

7.1 In the unlikely event that a client and/or the responsible person has cause for a complaint about a TNSF session, the complaint should be made to a representative of TNSF during the session in order that corrective action can be taken if necessary.

7.2 If the complaint is about a member of staff, then please contact the Director of TNSF Sonia Vant (Sionia@thenextstepsforwards.com) setting out the nature and evidence relating to the complaint within 28 days or this complaint will not be upheld.

8. ALLERGIES

8.1 If the client suffers from any allergies at all from substances such as nuts etc, then we advise the client to come fully catered for. We cannot be held responsible should they have any allergic reaction, by consuming any foodstuffs while at TNSF.

8.2 Clients with allergies will need to state accordingly on their booking form. 

9. DBS

9.1 All appointed staff at TNSF are DBS enhanced checked.

10. PHOTOGRAPHY AND VIDEO

10.1 We often take photographs throughout our sessions and events to use for our promotional material and website. Your acceptance is acknowledged via the photo consent form.

10.2 We would also ask for the client to gain the permission of peers before taking any photographs.
